1. GENERAL INFORMATION
Use of learning management system (LMS) through American Eagle Protective Services Corporation (“AEPS”) website or emails does not create a student or client relationship. A user or visitor is not considered a “customer, client or student” until coursework has begun and payment has been received in full
AEPS does not promise or guarantee that student will pass any class and/or that the State of Texas will approve every license application submitted just because payment for a course has been received
AEPS does not promise, suggest or advertise in any way that by taking any of our classes that employment will result from successful completion of any class. AEPS is not a placement agency.
AEPS reserves the right to refuse service to anyone for any reason at any time, which also includes professional conflicts of interest. AEPS will dismiss any student who is considered a safety or health risk to staff or students.
Student must satisfy all statutory requirements prior to attend any class at AEPS. Student must also disclose their Social Security Number (SSN) on the state forms (required by the state) in order to get their certificate /license.
Due to Federal Law: Ex-felons cannot use or possess firearms at any time, which prevents their attendance to any class containing firearm training such as: CHL, Level 3 Commission, Level 4 PPO, Advanced Weapons, etc. AEPS will also not knowingly train anyone who is using this training, information, and techniques for unlawful purposes.
The state of Texas only provides an English version to all state security and licensing exams; with that said, in order to comprehend and pass each course, all students must be able to read, write, and speak English. AEPS will not and cannot help any Student through the test, teach the test to the Student, or provide answers to Students at any time, as each Student must fully understand the fundamentals of all courses on their own.

Student acknowledges that in exchange for access to the information available on the website/LMS, and the ability to participate in the services offered on the website/LMS, Student is bound by this agreement.  AEPS may update, amend or change the website/LMS or this agreement at any time, without notice to Student; therefore, Student must consult the most recent version of this agreement each time Student visits the website/LMS.  Use of the website/LMS constitutes Student’s acceptance of this agreement, in its current form or as subsequently modified. 
2. NON-REFUNDABLE & NON-TRANSFERABLE FEES:
All fees paid to AEPS are Non-refundable and Non-transferable (to another person or another class date), and must be pre-paid in advanced. AEPS will not provide a refund, credit, or rain check if Student fails a test, unable to perform the course tasks, is dismissed from a course for any reason, and unable to complete the course for any reason.  While many sign up / pay then change their mind, it is sold regardless if Student completes the course or not.  Again all fees are Non-refundable and Non-transferable.
3. PAYMENT:
All payments must be received prior to receiving any instruction. No personal checks are accepted at any time. AEPS accepts all major credit cards and debit cards including PayPal and specifically listed approved mobile payment system listed in this agreement.  Once Student enrolls online, they will receive an invoice along with further course information and directions. If after paying Student does not receive any confirmation back, Student should contact AEPS.
Students that have their company paying for their training that do not provide a payment prior to enrollment, (and we have an agreement to bill your company), company will be mailed your training certificates once AEPS receives payment due in full for the training provided. All students will be responsible for their course fee if their company fails to pay in a timely manner. Companies that request to be billed, must set this up prior to the day of class and notify AEPS prior.
AEPS does not offer discounts or price reductions on course materials even if Student has materials required by the course.
Some restrictions may apply with AEPS’ offers or programs. Prices, offers, & discounts are subject to change to meet any outside or in-house logistical increases or changes.  Private lessons, special requests, travel programs, special scheduling needs, extended range or classroom time for any retesting, special administration tasks or consulting are all done at additional rates & charges if offered.
4. PRIVACY POLICY:
This privacy policy applies to the use of AEPS LMS, the products and services of www.aepscorp.com, and any other website, page, blog, services or capabilities that link to this Privacy Policy, Disclaimers, Purchase Policy or Terms of Use.
AEPS has adopted this policy to protect the privacy of and respect of our customers, visitors, and users to which each user shall adhere in connection with accessing this site, as each term is hereinafter defined.
This page informs you of AEPS’ policies regarding the collection, use and disclosure of Personal Information we receive from users of www.aepscorp.com. AEPS strives to offer each visitor a personalized experience while utilizing our site. AEPS may ask Student to provide certain Personally Identifiable Information that can be used to contact or identify the Student. Personally identifiable information may include, but is not limited to: Student’s name, email address, postal address and telephone number. AEPS will never sell, barter or rent Student’s personal information to any third party.
a) How information is gathered:
AEPS may include online forms, emails, newsletters, and online commenting areas that ask users to provide their information, such as their names, e-mail addresses, and additional contact information. AEPS servers may recognize users’ domain names and IP addresses; AEPS may log the name of users’ Internet Service Provider or use cookie technology to recognize Student and hold information from your visit. No personal information about the user is revealed in this process. Student can choose not to provide AEPS with information by setting the browser to refuse to accept cookies, but in doing so, Student may not be able to access certain portions of the site and we may be unable to customize the site’s features according to Student’s preferences.
            b) What We Do With Information Collected
            AEPS may collect information to enhance and deliver a more personalized experience for users. Information received and collected from AEPS LMS will never be shared or sold to any third party without prior consent, except as necessary to provide Student with the services offered or to comply with the law.  Anonymous information is used to analyze traffic to www.aepscorp.com. AEPS may use anonymous IP addresses to help diagnose problems with the server, administer the site, or display the content according to your preferences.
            c) Children’s Privacy Protection
            AEPS does not direct any of our content specifically nor target anyone under the age of eighteen (18). Any personal data collected by our site pertaining to a minor will be eliminated promptly; AEPS will not knowingly collect Personally Identifiable Information from a minor (children under the age of 18). ALL PERSONS UNDER THE AGE OF 18 ARE NOT PERMITTED TO ACCESS THIS SITE.
            d) Changes To This Policy
            We reserve the right to modify or change this policy at any time. Any information received prior to changes will be used according to the rules and laws applicable during the time the information was collected.
5. ASSIGNMENT.
Student assigns, and grants all rights, titles and interest to AEPS to gather, process, analyze, and retain any of the information Student voluntarily supply during their use of the Web Site. Student consents to the disclosure by AEPS of any of this information to third party entities in accordance with the Privacy Policy contained in this agreement. Student consents to the aggregation of their non-identifying information with like information from other people, and consent to the release of such aggregated information to other parties, including but not limited to the sponsors or third party service providers of AEPS. Student agrees that AEPS may mail or email Student information about AEPS current or future LMS courses.
6. LIMITATION OF LIABILITY
AEPS will not be held liable for any injuries or damages that may occur from the use of this site, including but not limited to: lost profits, incidental, special, or consequential damages or lost data arising from or within use of this site or any other materials or services rendered to you. Student will be held liable for damages or injuries including but not limited to the following: damages on our site; line failure; failure of our site; error on our site; inability of the use of our site; stalled or delay in transmission of our site; stalled or delay in operation of our site; omission on our site; defect on our site.
7. DISCLAIMER OF WARRANTY
Except as otherwise expressly provided herein, AEPS provides the AEPS website to Student on an “as is, with all faults” basis. AEPS expressly disclaims any and all other warranties, whether express, oral, implied, statutory or otherwise, including, but not limited to, the accuracy, completeness, correctness, timeliness or usefulness of any information, programs, products, or services, any implied warranty of merchantability, fitness for a particular purpose, title or non-infringement, adequacy to produce any particular result, accuracy or reliability of the use of, or the results of the use of, the website or that the website will meet your requirements or will be suitable for your needs.  Reliance on any information provided on this website or on any third party websites linked through this website is solely at your own risk.
AEPS does not warrant that the functions contained in the web site or LMS will be uninterrupted or error-free, that defects will be corrected or that the website, LMS, or the server that makes it available are free of viruses or other harmful components and all such warranties are expressly disclaimed.  Student assumes all risk of using the website and all risk of errors and/or omissions, including the transmission or translation of information in the website/LMS.  Student assumes the entire cost of all necessary servicing, repair or correction of Student’s systems or requirements needed to access the website/LMS.  Student assumes full responsibility for implementing sufficient procedures and checks to satisfy Student’s requirements for the accuracy and suitability of the website/LMS.   

8. TERMINATION
Either party may terminate this agreement at any time. AEPS is entitled to discontinue the use of all or any part of this site without notice to you. At any time, you have the right to terminate this agreement by eliminating any content or materials obtained from this site. 
Termination or cancellation of this agreement shall not affect any other right or relief to which AEPS may be entitled, whether at law or in equity.  Upon termination of this agreement, all rights granted to you will terminate and revert to AEPS, regardless of the reason for cancellation or termination.  Student agrees to certify in writing to AEPS their compliance with these requirements upon AEPS’s request.  All provisions in this agreement relating to proprietary rights, indemnification, warranty, and limitation of liability shall survive termination.
9. EXPORT CONTROL
This agreement is expressly made subject to any laws, regulations, orders or other restrictions on the export from the United States of America of the Web Site. Student agrees that they are not in a country where such export is prohibited or are a person or entity to which such export is prohibited. AEPS makes no representation that materials on the Web Site are appropriate or available for use in locations outside the United States of America, and accessing them from territories where their contents are illegal is prohibited. If you choose to access this Web Site from another country, Student does so on their own initiative and are responsible for compliance with the laws of their local jurisdiction regarding import or export of the Web Site and access software.
10. LINKS
When using the Web Site/LMS, Student may sometimes be linked to third party web sites or resources. Student acknowledges and agrees that AEPS is not responsible for the availability of any third party web sites or resources, and does not endorse and is not responsible or liable for any content, information, advertising, products, or other materials on or available from such sites or resources. Student further acknowledges and agrees that AEPS shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, information, goods or services available on or through any such site or resource. Links from this Web Site/LMS are provide for convenience only, and are not intended as an endorsement by AEPS of the organization or individual operating the third party web site or a warranty of any type regarding either the third party web site or the information on the third party web site. Student may link to any page on this Web Site only if Student’s links do not use any of AEPS’s proprietary trademarks, service names, trade names, logos, marks, or other distinctive graphics, video, or audio material and Student shall not link in a manner reasonably likely to 1) imply affiliation with or endorsement or sponsorship by AEPS or its affiliates; 2) cause confusion, mistake, or deception; 3) dilute AEPS’s trademarks or service marks; or 4) otherwise violate state or federal law.
11. MONITORING.
Student acknowledges that AEPS reserves the right to, and that AEPS may from time to time choose to, monitor any and all information transmitted or received through the website/LMS. AEPS, in its sole discretion and without further notice to Student, may review, censor or prohibit the transmission or receipt of any information which AEPS deems inappropriate or that AEPS determines violates any term or condition of this agreement.

12. PROPERTY RIGHTS; COPYRIGHT AND TRADEMARK INFORMATION AND USE RESTRICTIONS
All of the information included on this Web Site, including all the software text, course materials, graphics, logos, photographs, graphs, sounds, data, images, audio, page headers, software, buttons, video and other icons and the arrangement and compilation of this information (collectively, the “Information”) is the valuable property of AEPS. AEPS and its associated logos, custom graphics, and other icons are service marks, trademarks, registered service marks, or registered trademarks of AEPS. The Information is protected by contract law and various intellectual property laws, including USPTO and international copyright and trademark laws, and all intellectual property rights in the Web Site belong to AEPS or its licensors. The Information is the valuable, exclusive property of AEPS. Nothing in this Agreement shall be construed as transferring or assigning any ownership rights in the Information to you or any other person or entity. Ownership of the Web Site/LMS and the Information shall remain at all times with AEPS or its licensors. You have a license to use the Web Site, as long as you comply with the terms of this agreement or until AEPS terminates this agreement or Student’s access rights. Student may use the Information solely for browsing the Web Site or completing the coursework in connection with LMS. Student may not use the Information for any other purpose. Student may not copy, reproduce, republish, upload, store for subsequent use, post, transmit, alter, adapt, distribute, commercially exploit, sublicense or publicly display the Information or any portion of the Information in any manner whatsoever without AEPS’s prior written consent, except that Student may make such temporary copies as are necessary to browse the Web Site or complete the course in connection with LMS. Student may not resell, redistribute, broadcast or transfer the Information or use the Information in a searchable, machine-readable database or file. Student may not remove, alter or obscure any copyright, legal or proprietary notices in or on any portions of the Information. Student agrees to use the Web Site and the Information for lawful purposes only. All rights not granted to you herein are expressly reserved by AEPS or its licensors. AEPS and its licensors reserve all rights to enforce their copyright and intellectual property rights.
13. NO CONFLICTING TERMS.
If there is a conflict between this agreement and any enrollment contract for the AEPS LMS Course or other documents relating to the Web Site, this agreement shall govern, whether such agreement or other document is prior to or subsequent to this agreement, or is signed or acknowledged by any director, officer, employee, representative or agent of AEPS.
14. INDEMNITY
Student hereby agrees to indemnify, defend and hold harmless AEPS, its subsidiaries, licensors, affiliates, and their officers, directors, employees, affiliates, agents, representatives or subcontractors, for and against all claims or demands, including reasonable attorneys’ fees, arising from or related to Student’s access, connection to, or use of, or student’s inability to use, access, or connect to, the web site, (including information obtained through the website), student’s violation of this agreement or Student’s violation of any rights of another.
While AEPS LMS courses are open to anyone (currently working security or just starting out), AEPS LMS courses are designed for “Operator/User” level only. While all students are welcome to attend regardless what employer/agency Student might work for, AEPS strongly prohibits: Any type of Instructor/Assistant Instructor, to include Management or Owner of any type of Training School/Academy/Defense school, etc., from attending our classes for obvious “Conflict of Interest” reasons. Conflict of interest may be waived by AEPS but only prior to enrollment; any conflict perceived by AEPS will be grounds for automatic dismiss from use of LMS.

15. FORCE MAJURE
Any delays in or failure of performance by AEPS or any of its licensors, service providers, or service sponsors (including its and their officers, directors, employees, affiliates, agents, representatives and subcontractors) shall not give rise to any claims for damages, or any loss of liability, if and to the extent caused by interruptions due to electronic or mechanical equipment failures, telephone interconnect problems, defects, or occurrences beyond AEPS’s control, including but not limited to acts of governmental authority, weather, fire, floods, explosions, acts of God, strikes or other concerted acts of workers, riots, armed conflicts, acts of war, or sabotage.  AEPS shall have no responsibility to provide Student access to the web site during interruption of the website due to any such or similar cause shall continue.

Notices to you may be made via email, regular mail or by displaying notices or links to notices to you generally on the Web Site
17. GOVERNING LAW AND VENUE
This policy and the use of this website and LMS shall be construed in accordance with and governed by the state of Texas. If a dispute arises under this policy, Student hereby irrevocably consents to the exclusive jurisdiction of the state or federal courts in Travis County, Texas. This statement and the policies outlined within are not intended to and do not create any contractual or other legal rights in or on behalf of any party.
